Industrial Designs
Industrial Designs refer to the creative activity resulting in the ornamental or aesthetic appearance of a product. A design right is granted to the proprietor of a novel and original design that has been validly registered under law. Industrial designs form a vital component of intellectual property rights (IPRs). In compliance with the TRIPS Agreement, which sets out minimum standards for IP protection, India has amended its national legislation to align with these global norms.
The primary objective of design law is to protect and promote the visual design aspects of industrial production. It encourages innovation in product appearance and supports industrial creativity. In India, industrial design protection is governed by the Designs Act, 2000, which replaced the earlier 1911 legislation. This Act is designed to address the challenges posed by rapid technological advancement and evolving international practices.
India has developed a robust system for design registration and has aligned its framework with international standards, including adherence to the Locarno Classification system. The Act aims to classify and protect designs more precisely across diverse sectors, reflecting the growing significance of design-led innovation in a globalized economy.
