Trademark

A trademark is a distinctive sign or indicator used by a business or individual to distinguish their goods or services from those of others. It can consist of a word, phrase, logo, symbol, design, combination of colors, the shape of goods, packaging, sound, or even scent—any feature that clearly identifies the source of a product or service.

Trademarks play a crucial role in building brand identity and consumer trust, helping buyers recognize and choose products or services whose quality and origin they associate with the trademark. In essence, trademarks support informed purchasing decisions and brand loyalty.

Trademark registration in India grants the owner exclusive rights to use the mark for the registered goods or services and to legally prevent others from using similar marks that could cause confusion. The owner may also license the trademark to others or transfer ownership for commercial benefit.

The initial registration is valid for 10 years, and it can be renewed indefinitely for further periods of 10 years each, provided the renewal fees are paid on time. Registered trademarks serve as prima facie evidence of ownership and provide statutory protection under the Trade Marks Act, 1999.

In India, the trademark system is administered by the Office of the Controller General of Patents, Designs & Trade Marks (CGPDTM), functioning under the Department for Promotion of Industry and Internal Trade (DPIIT), Ministry of Commerce & Industry.
