Patents

A patent is a legal right granted for an invention—either a product or a process—that introduces a novel way of doing something or offers a technical solution to a specific problem. This exclusive right allows the patent holder to prevent others from making, using, distributing, or selling the invention without consent for a limited duration, typically 20 years from the filing date, subject to maintenance fees and compliance.

The patent owner has the authority to permit or restrict the use of the invention during the protection period. This may include granting licenses to third parties on mutually agreed terms or transferring ownership through sale. Once the patent term expires, the invention enters the public domain, meaning it can be freely used by anyone without infringement concerns.

In exchange for these exclusive rights, patent holders are legally required to publicly disclose the details of their invention. This disclosure contributes to the global pool of technical knowledge, fostering innovation, collaboration, and further research. In this way, patents serve not only as a tool for protecting intellectual property but also as a catalyst for technological advancement and economic development.

In India, the patent system operates under the regulations governed by the Department for Promotion of Industry and Internal Trade (DPIIT), under the Ministry of Commerce and Industry. The Office of the Controller General of Patents, Designs and Trade Marks (CGPDTM) is the authority responsible for administering patent-related services.
